TOWN OF SHERMAN — A 49-year-old man was caught speeding which resulted in his third OWI offense.
Leonard T. Sylvester, of Fredonia, was charged with misdemeanor third offense OWI.
According to the criminal complaint, a deputy was on routine patrol in the Town of Sherman when he observed a vehicle traveling at 79 MPH in a 55 MPH zone. When the deputy got behind the vehicle, he observed the vehicle deviating from its lane of travel, and that’s when the deputy stopped the vehicle.
The deputy started speaking with the driver, identified as Sylvester, when he detected an odor of intoxicants coming from the vehicle. The deputy asked Sylvester if he had been drinking and Sylvester stated that he was.
Sylvester was asked to perform a series of field sobriety tests. His performance on the field sobriety tests indicated to the deputy that he was under the influence of intoxicants to the point where he could not safely operate a motor vehicle.
